Marketplace Terms & Seller Policy
Rules for certification-gated trainer services and auction-only member product listings on the ElitePTS Marketplace.
Contents
Operational website terms prepared for the current marketplace model. These terms should receive final review by qualified Canadian counsel before payment processing, payouts, or binding auctions are enabled.
1. Scope & Agreement
These Marketplace Terms govern every seller account, trainer seller account, listing, service package, auction, bid, order, message, review, shipment, pickup, payout, and dispute on the ElitePTS Marketplace. They supplement the Terms of Use, Privacy Policy, Refund Policy, Shipping Policy, Acceptable Use Policy, Medical Disclaimer, and Liability Waiver.
By applying, listing, bidding, buying, ordering, reviewing, or messaging, you accept these Marketplace Terms. Rights and remedies that cannot lawfully be waived remain unaffected.
2. Marketplace Models
- Approved trainers may offer defined coaching and program service packages with clear prices, deliverables, timelines, communication expectations, and any verified reviews where the supporting workflow is available.
- Used fitness equipment and eligible sealed supplement products use timed member auctions only. General sellers may not create fixed-price product listings.
- The Elite Store is the separate first-party retail store. Marketplace seller listings are third-party listings unless expressly identified as sold by ElitePTS.
- ElitePTS provides the platform, moderation, transaction records, and dispute process but is not the trainer, manufacturer, owner, shipper, or seller of third-party listings.
3. Seller Accounts & Approval
- Sellers must be at least 18, provide truthful identity and contact information, accept marketplace standards, and remain in good standing.
- A general seller account may submit used-equipment and eligible-supplement auctions only.
- A trainer seller account is a privileged seller account for professional training services and requires the additional approval described below.
- Seller applications may be approved, rejected, suspended, restricted, or returned for changes. No storefront or listing is public until its required approval and moderation status is active.
- Accounts may not be sold, transferred, shared, or used to evade a suspension. One person may not operate undisclosed duplicate seller identities.
- Sellers are responsible for applicable registrations, licences, insurance, taxes, records, and legal obligations.
4. Trainer Certification & Service-Gig Rules
Before a trainer storefront or service gig is activated, the applicant must complete identity, credential, experience, profile, and standards review. A current recognized professional credential is a prerequisite.
- Recognized examples include canfitpro, CSEP, NASM, ACE, NSCA, ACSM, ISSA, and ISSN. ElitePTS may accept or reject other organizations after review.
- Applicants must provide the issuing organization, credential type and number, issue/expiry information, and supporting documentation.
- Verification is not permanent. Expired, suspended, revoked, unverifiable, or materially changed credentials may cause immediate restriction.
- Service listings must state scope, package deliverables, delivery time, revisions, prerequisites, availability, communication cadence, price, location or online format, and cancellation terms.
- Basic, Standard, and Premium package descriptions must be materially accurate. Trainers may not substitute undisclosed deliverables after purchase.
- Trainers must remain within professional scope, make no guaranteed-result claims, and refer medical, diagnostic, rehabilitation, or clinical matters to an appropriately qualified professional.
- Trainer sellers are independent providers unless a listing expressly states that ElitePTS is the service provider.
5. Auction Rules & Bidding
- General product listings are timed auctions only. Each auction must disclose the starting bid, minimum increment, end time, currency, condition, location, shipping/pickup terms, and any reserve.
- A bid is an offer to purchase and may become binding when the auction closes, subject to applicable law, payment authorization, reserve status, fraud review, and these Terms.
- Bidders must review the full listing before bidding. Bids cannot ordinarily be withdrawn merely because the bidder changed their mind or misread the listing.
- Sellers may not bid on their own items, arrange artificial bids, coordinate shill bidding, manipulate price, cancel to avoid an unfavourable result, or privately sell an active auction item to bypass the platform.
- ElitePTS may invalidate bids, extend or cancel an auction, withhold a result, or require additional verification where fraud, technical error, prohibited conduct, or listing illegality is suspected.
- Displayed countdowns are informational. The server-recorded closing time and accepted bid records control.
- The highest valid bid that satisfies any disclosed reserve is the presumptive winning bid. Taxes, shipping, duties, and other disclosed charges may be additional.
6. Used Equipment & Supplement Auction Rules
Product auctions are peer-to-peer transactions at the parties’ own risk. Moderation reduces risk but is not inspection, authentication, safety certification, or a guarantee.
- Equipment listings must disclose actual condition, defects, missing parts, repairs, modifications, recalls known to the seller, dimensions where material, and whether safe assembly or professional installation is required.
- Sellers must use current photographs of the actual item. Stock images may not replace actual-item images.
- Supplement auctions are limited to products authorized for sale in Canada and displaying an appropriate NPN, DIN-HM, or other required authorization identifier where applicable.
- Supplement containers must be factory sealed, tamper evidence intact, unexpired through a reasonable delivery/use period, correctly stored, and accompanied by clear photographs of the label, lot/batch information, seal, and expiry date.
- Opened, partially used, decanted, relabelled, homemade, recalled, counterfeit, contaminated, temperature-compromised, expired, prescription, controlled, or unauthorized health products are prohibited.
- Sellers may repeat only lawful label-authorized claims and may not claim that a supplement diagnoses, treats, cures, or prevents disease beyond authorized representations.
- ElitePTS may require proof of purchase or authenticity and may remove any product without completing a sale.
Health Canada advises that online natural health products may present risks including counterfeit, contamination, incorrect ingredients, lack of Canadian authorization, impermissible claims, and expiry. Buyers must independently review labels, authorization numbers, warnings, interactions, and suitability.
7. Listing, Moderation & Advertising Standards
- All material facts must be prominent, accurate, current, and understandable. Fine-print disclaimers cannot correct a misleading headline, image, price, credential, review, countdown, or claim.
- Listings must not use fake urgency, false scarcity, fabricated reviews, undisclosed endorsements, altered credentials, misleading before/after imagery, or unsupported performance or health claims.
- Sellers grant ElitePTS a non-exclusive licence to host, reproduce, resize, moderate, promote, and display listing content for platform operation.
- ElitePTS may edit categorization, request substantiation, require corrections, refuse publication, add warnings, or remove a listing.
- Approval does not transfer responsibility from the seller or constitute ElitePTS endorsement.
8. Transactions, Platform Fees & Payouts
- When commerce is enabled, payment must remain on-platform. Off-platform payment diversion, fee avoidance, or requests for unrecorded transfers are prohibited.
- The buyer authorizes the displayed transaction amount, applicable taxes, shipping, and disclosed charges. Payment may be held until acceptance, delivery milestones, or dispute windows are satisfied.
- ElitePTS may deduct disclosed platform fees, processor fees, refunds, chargebacks, taxes, reserves, penalties, or other authorized amounts before payout.
- Seller dashboards will show the applicable fee and payout schedule. ElitePTS may delay payout for fraud review, disputes, verification, legal compliance, or account risk.
- Each seller is responsible for income, sales, GST/HST, provincial, customs, and other tax obligations applicable to that seller.
9. Service Delivery, Shipping & Pickup
- Trainer sellers must begin and complete services within the listing and order terms, communicate delays, and preserve relevant delivery records.
- Product sellers must package safely, use the agreed shipping method, provide tracking where promised, and ship within the disclosed handling period.
- Local pickup arrangements should use safe public locations when practical. Users should not disclose unnecessary residential or personal information.
- Risk of loss, title transfer, and delivery confirmation are subject to the disclosed transaction terms and applicable law.
- Dangerous, unsanitary, structurally compromised, or recalled equipment must not be delivered or collected.
10. Returns, Cancellations & Refunds
Seller terms apply only to the extent consistent with mandatory consumer rights. Materially misdescribed, counterfeit, prohibited, undelivered, unsafe, or unauthorized products and undelivered service commitments may qualify for platform review and remedies.
- Auction bids and completed auction purchases are generally final except where law, these Terms, fraud review, or a successful dispute provides otherwise.
- A buyer’s inspection, acceptance, pickup, or use may affect available remedies but does not waive rights that cannot legally be waived.
- Trainer service cancellation and revision terms must be disclosed before order placement.
- ElitePTS may issue or require a refund, partial refund, replacement, redelivery, credit, order cancellation, or payout reversal following review.
11. Reviews, Ratings & Reputation
- Reviews must reflect a genuine transaction or experience and must not be fabricated, purchased, coerced, selectively suppressed, or exchanged for undisclosed compensation.
- Conflicts of interest must be disclosed. Sellers may respond professionally but may not threaten or harass reviewers.
- ElitePTS may label verified-purchase reviews, investigate manipulation, remove unlawful or inauthentic content, and preserve records required for enforcement.
- A verification badge concerns the reviewed status shown; it is not a guarantee of outcome, compatibility, product quality, or future conduct.
12. Safety, Health & Assumption of Risk
Exercise, coaching, used equipment, supplements, shipping, and in-person pickup involve risks. Users are responsible for assessing suitability and obtaining professional medical advice where appropriate.
- Stop exercise and seek appropriate care for concerning symptoms. Marketplace content is not medical advice, diagnosis, treatment, rehabilitation, or emergency service.
- Inspect, assemble, install, maintain, and use equipment according to manufacturer instructions and applicable safety requirements.
- Before using a supplement, review its Canadian authorization, label, warnings, contraindications, interactions, directions, seal, lot, and expiry, and consult an appropriate healthcare professional where needed.
- No seller may guarantee health, body-composition, performance, financial, or other outcomes.
13. Marketplace Privacy
Marketplace operation may require identity, certification, seller, listing, bidding, order, payment, shipment, message, dispute, review, fraud-prevention, device, and usage information. Public profiles and listings are public by design. Private information is handled under the Privacy Policy.
- Transaction counterparties receive only information reasonably required to perform the transaction.
- Credential and identity documents are restricted to authorized review and compliance workflows and should not be placed in public listing descriptions.
- Payment providers process payment information under their own privacy terms; ElitePTS does not need to store full payment-card details.
- Records may be retained for security, fraud, disputes, accounting, tax, legal compliance, and enforcement.
14. Prohibited Listings & Conduct
- Illegal, stolen, counterfeit, recalled, unsafe, contaminated, expired, opened, relabelled, or unauthorized products.
- Prescription drugs, controlled substances, anabolic steroids, SARMs, prohibited performance-enhancing drugs, needles, or medical devices requiring authorization not demonstrated by the seller.
- Weapons, hate content, sexual services, pyramid schemes, deceptive business opportunities, credential rentals, impersonation, harassment, and discrimination.
- Malware, scraping, automated bid manipulation, account takeover, money laundering, false chargebacks, transaction laundering, or circumvention of marketplace controls.
- Medical treatment offered by persons not lawfully qualified or service claims outside a trainer’s verified scope.
15. Disputes, Holds & Enforcement
- Users should use platform messaging and preserve photographs, tracking, service records, listing copies, and other evidence.
- A dispute may be opened through support within the period displayed for the transaction. ElitePTS may request information and may place funds or accounts on hold.
- ElitePTS may warn, restrict, suspend, terminate, remove content, invalidate bids, cancel transactions, refund buyers, reverse payouts, report activity, or preserve and disclose records where lawfully required.
- Marketplace mediation is an administrative platform process and does not replace legal rights, regulatory complaints, payment-provider remedies, or court processes.
16. Platform Role, Disclaimers & Liability
To the fullest extent permitted by law, third-party listings, services, products, communications, and transactions are provided by independent users. ElitePTS does not warrant seller identity beyond the scope of the stated verification, product authenticity, equipment safety, supplement suitability, service outcomes, uninterrupted availability, or that every violation will be detected.
Nothing in these Terms excludes liability or consumer rights that cannot be excluded under applicable law. Any limitation is subject to those mandatory rights.
17. Governing Law & Consumer Rights
These Marketplace Terms are governed by the laws of Alberta and the federal laws of Canada applicable there, without limiting mandatory protections that apply based on the user or transaction. Alberta’s Internet Sales Contract rules may apply to qualifying online consumer transactions, and Canadian competition law prohibits false or misleading marketplace representations.
18. Changes & Contact
We may update these terms for legal, safety, operational, or product changes. Material changes will be identified by the updated date and, where appropriate, communicated to affected account holders.
